Against Independent Algorithm Audits

The clamour for independent algorithm audits has grown into a chorus, with advocates insisting that transparency is the only path to accountability. Yet this demand, however well-intentioned, rests on a series of flawed assumptions that threaten to undermine the very innovation it purports to regulate. Independent audits, far from being a panacea, risk introducing new forms of opacity, stifling competition, and creating a false sense of security that may prove more dangerous than the problems they seek to solve.

To begin, the notion that an external auditor can meaningfully assess a proprietary algorithm is fraught with practical difficulties. Algorithms are not static artefacts; they are dynamic systems that evolve through continuous learning and adaptation. An audit conducted at a single point in time captures only a snapshot, a frozen moment that may bear little resemblance to the system’s behaviour a week later. Moreover, the complexity of modern machine learning models—often comprising billions of parameters—defies straightforward interpretation. Even the engineers who build these systems struggle to explain their outputs fully; expecting an external auditor to do so is unrealistic. The result is a superficial review that may satisfy regulatory checkboxes but provides no genuine insight into the algorithm’s real-world impact.

Furthermore, independent audits impose significant costs that disproportionately affect smaller players. Compliance with audit requirements demands substantial resources: legal fees, technical documentation, and the hiring of specialised consultants. Large technology firms can absorb these costs, but startups and smaller organisations may be driven out of the market entirely. This dynamic entrenches the dominance of incumbents, reducing competition and innovation. The very entities that most need scrutiny—the tech giants—are best positioned to comply, while smaller, potentially more ethical alternatives are squeezed out. The audit regime thus becomes a barrier to entry, not a tool for accountability.

A more insidious danger lies in the illusion of safety that audits create. When an algorithm receives a clean audit report, the public and regulators may assume it is fair and unbiased. The infamous case of Amazon’s recruitment algorithm, which was found to penalise women’s résumés, illustrates the point: even internal reviews missed the bias until it was too late. The seal of approval may lull stakeholders into complacency, discouraging ongoing vigilance.

Additionally, the push for independent audits often conflates transparency with understanding. Requiring companies to disclose their source code or training data may reveal trade secrets without actually clarifying how decisions are made. Proprietary algorithms are valuable intellectual property; forcing their exposure could undermine competitive advantage and discourage investment in research and development. The European Union’s experience with the General Data Protection Regulation (GDPR) offers a cautionary tale: the right to explanation has proven difficult to implement in practice, with companies providing opaque, boilerplate responses that satisfy legal requirements but offer little genuine insight. Audits risk a similar outcome—producing reams of documentation that obscure rather than illuminate.

Proponents argue that audits are necessary to prevent algorithmic harm, from biased lending to discriminatory policing. But the solution to these problems is not a one-size-fits-all audit mandate. Instead, we should focus on outcome-based regulation that holds companies accountable for the results of their algorithms, not the internal mechanics. If an algorithm produces discriminatory outcomes, the company should be liable, regardless of whether an audit would have predicted the failure. This approach incentivises companies to build robust testing and monitoring systems internally, tailored to their specific contexts, rather than outsourcing responsibility to external auditors who lack deep familiarity with the system.

Consider the case of credit scoring algorithms. In the United States, the Equal Credit Opportunity Act already prohibits discrimination on the basis of race, colour, religion, national origin, sex, marital status, or age. Lenders are required to maintain records and provide explanations for adverse actions. This outcome-focused framework has been effective without mandating independent audits of the underlying models. Similarly, in Australia, the Australian Securities and Investments Commission (ASIC) oversees responsible lending practices through regular reviews and enforcement actions, not by auditing every algorithm. These examples demonstrate that accountability can be achieved without the heavy-handed intervention of independent audits.

Another concern is the potential for audits to become a bureaucratic exercise that stifles innovation. The process of preparing for an audit diverts engineering talent from improving the algorithm to documenting its behaviour. This administrative burden slows the pace of development and discourages experimentation. In fields like healthcare and autonomous vehicles, where algorithms can save lives, such delays are not merely inconvenient—they are deadly. The cost of caution must be weighed against the cost of inaction.

Finally, the push for independent audits often ignores the role of human judgment in algorithmic systems. Algorithms do not operate in a vacuum; they are embedded in social and organisational contexts that shape their use. An audit that examines the algorithm in isolation may miss the ways in which human operators override, misinterpret, or selectively apply its outputs. True accountability requires examining the entire socio-technical system, not just the code. This is a far more complex undertaking than any audit can provide.

In conclusion, while the desire for algorithmic accountability is laudable, independent audits are a flawed instrument. They offer the illusion of transparency without genuine insight, impose disproportionate costs on smaller players, and risk creating a false sense of security. A more effective approach lies in outcome-based regulation, internal accountability mechanisms, and a recognition that algorithms are part of broader systems that require holistic oversight. We must resist the seductive simplicity of the audit and embrace the messy, ongoing work of building fair and responsible technology.
